NX Notary is based in Indiana and may provide online notary services to customers located in other states or jurisdictions when the requested transaction is legally eligible for remote notarization.

2. What a Notary Does
A notary public performs a notarial act in accordance with applicable law.

A notary does not determine whether a document is legally appropriate for your particular situation.
3. No Legal Advice
NX Notary and its notaries do not provide legal advice.
A notary cannot advise you about:

4. Signer Requirements
Customers requesting remote online notarization must satisfy applicable requirements for the requested notarization.
Depending on the transaction, this may include:
- Appearing before the notary through required audio-video technology
- Providing acceptable identification
- Successfully completing identity verification
- Completing knowledge-based authentication or other required verification
- Being able to communicate with the notary
- Having the mental capacity and willingness to complete the transaction

The notary may refuse to perform a notarial act when required or permitted by applicable law.
5. Remote Online Notarization Technology
NX Notary may use an approved remote technology vendor to conduct online notarizations.
Indiana requires Indiana remote notaries to conduct remote notarial acts through an approved remote technology vendor. (InBiz)
The technology provider may perform functions such as identity verification, electronic signing, audio-video communication, document handling, electronic records, and other technology functions required for the remote notarization.
Technical requirements, availability, and fees may vary by provider.
6. Document Responsibility
You are responsible for providing documents that are complete and ready for notarization unless otherwise agreed.
NX Notary does not determine whether the information contained in your document is accurate, complete, legally sufficient, or appropriate for your circumstances.
You should review your document before the notarization begins.
7. Refusal or Inability to Notarize
NX Notary may decline or stop a notarization when required or permitted by applicable law or when necessary requirements cannot be satisfied.
Examples may include:
- Failure to establish identity
- Failure of required identity verification
- Inability to communicate with the signer
- Technical problems preventing completion
- The signer appearing unwilling or unable to proceed
- Questions concerning the legality or propriety of the requested notarial act
- The document or transaction not being eligible for the requested service
A decision to refuse a notarial act may be based on legal requirements applicable to the notary.
8. Fees and Payments
Fees for services will be disclosed before or during the scheduling or payment process, as applicable.
Third-party technology providers may charge separate fees depending on the service being used.
You are responsible for providing accurate payment information and paying applicable charges associated with services you request.
9. Cancellations and Refunds

10. Third-Party Services
NX Notary may use third-party providers for technology, scheduling, payment processing, communications, identity verification, document handling, or other business functions.

11. Website Use
You agree not to:

NX Notary is also not responsible for delays or failures caused by third-party technology providers, internet service interruptions, or circumstances beyond our reasonable control.
Nothing in these Terms is intended to waive any rights or protections that cannot legally be waived.

These Terms will be interpreted under applicable laws of the State of Indiana, except where applicable law requires otherwise.
